Análise da situação à luz da legislação brasileira vigente e dos princípios da bioética. Discussão sobre as possibilidades de aplicação dos princípios da bioética à psiquiatria. Necessidade de legislação protetiva específica e, sobretudo da fiscalização de seu cumprimento por conselhos sociais e pelo Ministério Público a fim de garantir-lhe a eficácia.
