Abstract

Este trabalho tem como objetivo o estudo da seguinte hipótese: os direitos fundamentais sociais constituem limites materiais ao Poder Reformador? Procura-se desenvolver uma resposta a este questionamento analisando-se o Poder Constituinte, a Constituição e os Direitos fundamentais. Ao fim do estudo, conclui-se pela intangibilidade dos direitos sociais, tendo em vista que a sua abolição importaria em flagrante retrocesso social e em violação da identidade constitucional.
