A Emenda Constitucional n. 45/2004 aumentou a competência da Justiça do Trabalho, que passou a ser encarregada de processar, ordinariamente, todos os litígios decorrentes da relação de trabalho, seja ela pública ou privada. Tal alteração exigirá mudança na postura dos juízes do trabalho e nova reciclagem de direito civil, administrativo, processual e constitucional. De conseqüência, também as atribuições do Ministério Público do Trabalho foram sensivelmente elastecidas.
