Por uma poética do direito: introdução a uma teoria imaginária do direito (e da totalidade)

O artigo propõe a retomada de estudos do direito situados em um quadro mais amplo, tal como idealizado e, a seu tempo, em parte, também realizado pelo italiano Giambattista Vico, no século XVIII, quando contrapôs ao racionalismo de matriz cartesiana uma abordagem calcada no que se pode denominar a utilização poética da linguagem, o que converge para os estudos contemporâneos em filosofia, quando se vê na linguagem o que há de mais fundamental a ser perquirido, bem como com propostas as mais diversas, oriundas igualmente das ciências humanas, no sentido de apontar para o caráter fundante que tem a imaginação no esforço humano de entender qualquer manifestação mundana ou consciencial.
