O presente artigo apresenta uma abordagem do direito a partir de uma perspectiva da hermenêutica filosófica de Gadamer como uma alternativa ao purismo metodológico típica de uma perspectiva positivista. É abordada a evolução da epistemologia e sua transposição das ciências naturais para as ciências sociais, especialmente para o Direito, e as modificações ocorridas no século XX a partir das críticas de Karl Popper. Será também exposta a reviravolta lingüística na filosofia ocidental, que traz o referencial adequado
para se superar as dificuldades da concepção empirista de método e a inadequação da concepção construtivista para o Direito.
