Inobstante a evolução normativa dos direitos fundamentais das mulheres no Brasil, as profissionais do sexo ainda são vítimas de discriminação de gênero e preconceito social, o que reflete na efetividade de seus direitos mais básicos. Essa situação é agravada pela adoção do sistema abolicionista pelo Ordenamento brasileiro, que não regulamenta nem criminaliza a prostituição, mas apenas algumas condutas que ocorrem no entorno da atividade. Nesse diapasão, objetiva-se com este artigo mostrar como a regulamentação da atividade prostituinte pode auxiliar na efetivação dos direitos fundamentais das prostitutas brasileiras.
