O direito e a caverna

Análise da construção de veredictos em sessões de júris simulados realizados por alunos de 1º semestre de curso de graduação em Direito, baseados no Caso dos Exploradores de Cavernas, de Lon L. Fuller. A constatação de que havia uma regularidade na absolvição dos 04 acusados de homicídio, fundada no estado de necessidade como excludente de ilicitude, demonstra que o atendimento a um preceito normativo, mesmo aquele que veicule valores fundamentais como o direito à vida, pode legitimamente deixar de ser observado. Objetivamos demonstrar que esta excludente de ilicitude e conseqüente exclusão de sancionamento para tal conduta – matar alguém – expressa num veredicto de júri popular encontra justificativa na teorização da construção social da realidade.
