Abstract

O presente estudo concentra-se sobre o pensamento de Miguel Reale, o maior expoente do tridimensionalismo no Brasil, com o objetivo de introduzir o leitor a essa teoria, investigar os três elementos da realidade jurídica apontados e, finalmente, tentar estabelecer uma concreção unitária entre eles para tratar problemas tradicionais da ciência do direito, tais como os discutidos conceitos de vigência, eficácia e fundamento. A seguir, serão observadas outras particularidades da obra de Reale, culminando com seu culturalismo histórico, pano de fundo importante e que não pode ser deixado de lado. Finalmente, tenta-se colocar uma conclusão crítica e oferecer perspectivas para posteriores desenvolvimentos do tema.
