O Sistema Interamericano de Direitos Humanos tem o papel de atuar na responsabilização internacional pelas violações de direitos cometidas em âmbito interno dos Estados-partes que ratificaram a Convenção Americana de Direitos Humanos. A Corte Interamericana de Direitos Humanos atua de forma subsidiária, diante da ineficácia da prestação de tutela jurisdicional estatal. Nesse contexto, destaca-se o caso Damião Ximenes Lopes, que gerou a primeira condenação do Brasil perante a Corte Interamericana de Direitos Humanos. Por meio do método dedutivo, este artigo pretende apontar os reflexos desse caso trouxe no direito brasileiro.
