O Direito a não saber: novos contornos do direito à intimidade

Na sociedade contemporânea, nominada de sociedade da informação, os contornos clássicos do direito fundamental à intimidade não se afiguram mais capazes de proteger os dados pessoais de cada um. Se antes esse direito era concebido como um direito de proteção do indivíduo ante as interferências externas, presentemente, mesmo pelo progresso tecnológico e científico, mais parece que se deva tutelar o direito à autodeterminação informativa. Nesse contexto, o presente trabalho tem por objetivo analisar a decisão proferida pela 3ª Turma do Superior Tribunal de Justiça no Recurso Especial 1.195.995/SP, que colocou em discussão a existência de direito a não saber de determinada informação médica correta e sigilosa, porém não requisitada pelo paciente, como corolário do direito à intimidade. Pretende-se com o estudo aponstar os novos contornos conceituais do direito fundamental à intimidade na atualidade. Para tanto, foi realizada pesquisa bibliográfica e documental na doutrina, jurisprudência e legislação nacional e comparada.Downloads
