A proposta do presente artigo é uma reflexão sobre a visão de processo como instrumento da jurisdição, enfrentando, de forma crítico-científica, a concepção de processo e seus institutos, momento a partir do qual se tentará demonstrar as aporias teórico-metodológicas dessa concepção, desconstruindo sua aplicabilidade no paradigma democrático que desagua na necessária reflexão sobre elementos externos ao sistema jurídico. Por conseguinte, buscando uma estabilização interpretativa, tentaremos delinear a legitimação dentro do Estado Democrático de Direito, que tem como consequência lógica a tentativa de construir uma metodologia de legitimação democrática da decisão a partir do novo Código de Processo Civil e institutos trazidos pelo seu complexo normativo, sem em vista da concepção de processo constitucional e perpassando pelo contraditório, simétrica paridade e ampla defesa, como elementos estruturais garantidores do ideal democrático, aptos a permear o procedimento processual de participação na construção do ato jurisdicional por meio de um processo comparticipativo e policêntrico.Downloads
