Abstract

O presente artigo apresenta e desenvolve algumas teses a nosso ver elementares e vitais para o advento consciente de um Constitucionalismo novo (não confundir, evidentemente, com neoconstitucionalismo), que se poderá designar por 4.0. Para isso, é necessária uma compreensão histórico-filosófica profunda das fases anteriores, um diagnóstico agudo da situação atual de ataque, desprezo e olvido das constituições em vários países e uma confiança (feita também de muito trabalho) nas energias teóricas e práticas dessa grande conquista civilizacional, que esbarra hoje com outras racionalidades e irracionalidades, desde os interesses à superficialidade, a incultura e a tecnocracia. Uma das novas bandeiras de esperança é a criação de um Tribunal Constitucional Internacional, para a Democracia, os Direitos
Humanos e o Estado de Direito.
