Abstract

O presente estudo analisa a responsabilidade (objetiva) do Estado por danos causados a indivíduos e grupos sociais em razão de eventos climáticos extremos resultantes do fenômeno das mudanças climáticas, considerando os aspectos socioeconômicos que lhe são correlatos e a atuação omissiva ou insuficiente do ente estatal em face dos deveres de proteção do ambiente que lhe são impostos pela Lei Fundamental brasileira de 1988. Com base em tal entendimento, aborda-se também o dever do Estado brasileiro de assegurar a tais pessoas, inclusive em termos prestacionais, condições materiais mínimas de bem-estar (individual, social e ecológico), o que se dá independentemente da sua responsabilização pelos danos causados.
