Abstract

Os movimentos territoriais migratórios entre Estados, oriundos de danos ambientais, geram um novo tipo de refugiado não protegido juridicamente pelos ordenamentos nacionais e internacionais. Os problemas quanto a essa situação ocorrem pela ausência de conceituação legal. O objetivo geral deste artigo repercute na busca por um sistema jurídico de cooperação entre os Estados e nas possíveis formas de o Direito Internacional dos Direitos Humanos de protegerem os refugiados ambientais. O trabalho se desenvolverá valendo-se de uma pesquisa bibliográfica, descritiva e exploratória. Percebe-se que os riscos e os danos ambientais enfrentados pelos deslocados ambientais necessitam de medidas urgentes e emergenciais, que são possíveis por meio da elaboração de um documento específico que traga a conceituação formal da expressão “refugiado” ambiental, ou da retificação de instrumentos jurídicos nacionais e internacionais que os protejam com o objetivo de orientar e esclarecer sobre as celeumas provocadaspor esse tema.
