Abstract

A globalização e a revolução tecnológica tornaram o mercado mundial extremamente competitivo, dificultando a sobrevivência de diversas empresas. A essa nova realidade somam-se as crises econômicas que despertam a necessidade de mudança de paradigmas e levantam a discussão em torno da proteção do trabalhador: será ela excessiva? Fruto de lutas sociais, os direitos dos trabalhadores são considerados fundamentais e devem ser protegidos pelo Estado. Em contrapartida, os encargos desse contratos muitas vezes tornam difícil a manutenção das empresas no mercado. Assim, surge o debate entre aqueles que pregam a liberdade do empregado e do empregador para contratarem e de outro os que negam essa possibilidade, sustentando a necessidade de regulamentação e proteção estatal. Com o objetivo de proporcionar uma nova abordagem acerca do tema, os autores propõem a aplicação da análise econômica do direito.
