O direito ao planejamento familiar é assegurado constitucionalmente e regulamentado pela Lei nº. 9.263, de 12.01.96. O Ministério da Saúde lançou a Política Nacional de Direitos Sexuais e Direitos Reprodutivos, ampliando as ações voltadas ao projeto parental. Um dos eixos de ação dessa Política é a introdução das tecnologias de reprodução assistida no Sistema Único de Saúde, entre elas a inseminação artificial heteróloga. Na utilização desta técnica, observa-se de um lado um doador que se propõe anônimo, oferecendo seus gametas para viabilizar o projeto parental de outrem e no outro extremo, temos uma criança que, embora tenha mãe e pai, ao crescer poderá reclamar o direito de conhecer sua ascendência genética. Tem-se, então, um conflito entre o direito ao conhecimento da ascendência genética e o direito à intimidade, um problema que envolve os chamados direitos fundamentais de quarta geração e uma nova discussão a respeito do Direito de Família, todos revolucionados pelos progressos da engenharia genética.Downloads
