O Direito assiste a progressiva massificação dos conflitos dentro de uma sociedade cada dia mais massificada e fragmentada. O judiciário, não podendo passar ao largo dessa realidade, tenta assumir o papel de solucionar a série de conflitos antes inexistentes ou represados na sociedade. Paulatinamente, ocorrem as chamadas ondas de acesso à justiça, as quais, contudo, deságuam numa contradição: permitem cada dia mais o acesso aos tribunais, estes são transformados em pesadas estruturas, incapazes de resolver os conflitos de forma célere, adequada e efetiva. Nessa senda, surgem certos mecanismos de solução dos conflitos de massa, trazendo consigo uma nova leitura do princípio da inafastabilidade da jurisdição e do acesso à justiça.Downloads
