The (green) heart of the matter: a vertente procedimental da tutela do ambiente e a revisão da lei de bases do ambiente

A Lei de Bases do Ambiente (LBA) completou, em 2007, a idade de 20 anos. Apesar de a existência da LBA ter sido determinante para a construção do edifício legislativo ambiental que hoje temos, o legislador ambiental português é refém do dirigismo promovido pelo Direito da União europeia e esse facto reduz decisivamente a importância real da LBA. A utilidade ou não da revisão da LBA, portanto, se encontra neste dístico: se falamos em termos formais, a revisão é relevante, para pôr a Lei de Bases de acordo com a legislação de desenvolvimento, esmagadoramente fruto dos indirizzos normativos da União Europeia; se pensarmos numa perspectiva material, a revisão é praticamente irrelevante em face da autêntica autoregência do Direito Ambiental da União Europeia. Cientes destas limitações, desenvolveremos nossos estudos sobre a vertente procedimental da protecção ambiental ou, por outras palavras, sobre o real significadoda fórmula do “direito ao ambiente” que a Constituição da República Portuguesa contempla no artigo 66º/1.
