Una expresión que encierra múltiplas actividades, la Unidad del ordenamiento jurídico es tomada como una característica o axioma o postulado del Derecho. Hija del Derecho Natural de tradición racionalista, fue adoptada por el Derecho Positivo. En lo que toca la unidad como un todo y en cuanto unidad de la Constitución, el análisis presentado es conducido bajo los aspectos racionales, históricos y positivistas, así como bajo la orientación de la teoría estructurante del Derecho. La conclusión es que la Unidad del ordenamiento jurídico – como un dato o una meta inspiradora de la práctica jurídica – es ilusoria.
