O preenchimento dos conceitos indeterminados nos tipos disciplinares: considerações sobre uniformização, regime de sujeição especial e discricionariedade

Os tipos administrativos disciplinares, por vezes, são vazados em termos legais sem alto grau de densificação. Essa técnica legislativa é conhecida como conceitos administrativos indeterminados (de forma mais geral) ou tipos abertos (de forma mais específica). Este trabalho visa analisar, após apresentar o estado atual em que se encontra a atuação prática da matéria disciplinar no âmbito da administração pública federal, como se dá o preenchimento desses tipos na aplicação das penalidades disciplinares, enfocando os temas da uniformização de entendimentos, da existência ou não de discricionariedade nessa tomada de decisão e da eventual influência da idéia de regime especial de sujeição.
